摘要
基层治理在法治社会建设中有着重要意义,它是法治社会建设的主要场域和现实进路。法治社会建设落地为基层治理,社会转型问题在基层治理中凸显。基层治理在法治社会建设上面临诸多困难,法治体系的矛盾在基层显现,基层干部群众法治观念相对落后,基层治理的法治基础相对薄弱。这些困难同时也是基层治理法治化的机遇。基层社会的特质对法治社会建设产生了制约,包括基层生产生活的季节性和周期性,基层社会人际关系的前现代色彩,基层社会资源匮乏的“拥挤”特性,基层社会事务的不规则性等。基层治理需要直面这些特性,以社区治理秩序、街头管理秩序、纠纷解决与法律服务等为着力点展开,关注基层民生保障、土地房产权益等重要事务的处理,并从中推进法治社会建设。
Community-level governance is greatly significant in that it is the main field of and a realistic approach to the construction of a rule of law society.The construction of a rule of law society has been implemented at the community level,and the issue of social transformation is highlighted in the community-level governance.As a matter of fact,the community-level governance faces many difficulties in the construction of a rule of law society:for example,the contradictions in the rule of law system appear at the community level;the government officials and people in the communities have insufficient understanding of rule of law;and the foundation of rule of law is relatively weak for the governance at the community level.However,these difficulties are also opportunities for developing rule of law at the community level.The construction of a rule of law society at the community level is under constraints imposed by the characteristics of the community-level society such as the seasonality and periodicity of production and life there;the premodern character of interpersonal relations in the communities;the“crowdedness”in the communities due to the lack of resources;and the irregularity of the social affairs at this level.The community-level governance needs to face these challenges directly,by focusing on the creation of order in community governance and street management and on the supply of dispute resolution and legal services and by paying due attention to the handling of important issues such as grassroots livelihood security and land and real estate rights protection so as to promote the construction of a rule of law society.
