摘要
海南自由贸易港未来在引入临时仲裁制度时,首先,建议国务院提请全国人大授权海南自由贸易港自行制定适用于自贸港内的临时仲裁规则或条例;其次,通过借鉴中国香港、新加坡等知名自由贸易港的临时仲裁经验,选择适用于自贸港内的临时仲裁模式,明确临时仲裁员的披露义务和责任,构建临时仲裁的监督机制等,从而构建海南自贸港临时仲裁制度。
When Hainan Free Trade Port introduces the ad hoc arbitration system in the future,firstly it is recommended that the State Council request the National People’s Congress to authorize Hainan Free Trade Port to formulate ad hoc arbitration rules or regulations applicable to the free trade port. Secondly,by learning from the ad hoc arbitration experience of the well-known free trade ports such as Chinese Hong Kong and Singapore,choosing the ad hoc arbitration model applicable to the free trade port,clarifying the disclosure obligations and responsibilities of ad hoc arbitrators,and building a supervision mechanism for ad hoc arbitration,the ad hoc arbitration system in Hainan Free Trade Port can therefore be constructed.
