摘要
机构改革后,基层市场监管执法成效显著,但改革初期无法避免的种种困境也使基层市场监管执法效能受到制约。结合对洛阳市某区市场监管局执法实践调研,论文分析了机构整合完成初期基层市场监管执法面临的法律法规体系不完善、执法业务融合不足、基层执法人员数量与执法任务不匹配、执法人员被追责常态化、执法效果与立法目的存在差距等问题,并围绕公平与效率、权力与责任对基层市场监管执法效能提升的具体途径进行了阐释,提出了完善法律法规体系、强化执法人员业务能力建设、补齐补强基层执法力量、合理设定行政人员执法责任、规范市场监管领域权责清单等举措,以期能为基层市场监管执法效能提升提供一些参考。
After the reform of organization,the law enforcement of the substrate market supervision has achieved remarkable results.However,at the beginning of the reform,various difficulties which cannot be avoided also restrict the effectiveness of the law enforcement of substrate market supervision.Based on the investigation of the law enforcement practice of a district market supervision bureau in Luoyang city,this paper analyzes the problems of imperfect legal and regulatory system,insufficient integration of law enforcement business,mismatch between the number of substrate law enforcement personnel and the task of law enforcement,normalization of law enforcement personnel being pursued,and the gap between the effect of law enforcement and legislative purpose.It also explains the specific ways to improve the efficiency of law enforcement in the substrate market supervision about fairness and efficiency,power and responsibility.In order to provide some reference for improving the efficiency of law enforcement of substrate market supervision,some measures are put forward,such as improving the legal system,strengthening the construction of the professional ability of law enforcement personnel,supplementing and strengthening the substrate enforcement force,reasonably setting the law enforcement responsibility of administrative personnel and standardizing the list of rights and responsibilities in the field of market supervision.
