摘要
法社会学理论根据社会现实中的实力和资源差距将诉讼中的当事人分为"单次当事人"和"重复当事人"。"重复当事人"在诉讼过程乃至整个法律体系中都占据优势。在银行理财纠纷中,金融消费者与银行分别属于"单次当事人"和"重复当事人",二者资源不平等限制了金融消费者依法求偿权的实现,削弱了法律体系在社会实践中运作的合理性和有效性。为弥补银行与金融消费者之间的资源不平等,应该利用组织机构将金融消费者从"单次当事人"整合为"重复当事人",加强金融监管机构在银行理财争端解决中对金融消费者的支持作用。
In the theories of legal sociology, litigate parties are often divided as"one-shotters"and"repeated players", according to their differences in resources. The"repeated players"have advantages not only in litigation but also in the whole legal system. In financial disputes, banks are"repeated players"and the financial consumers are"one-shotters". The inequality of resources between them not only restricts the remedy claiming right of financial consumers, but also undermines the effectiveness and rationality of legal system in the society. By involving and supporting financial consumers in litigation, the financial consumer protection organizations should reorganize the consumers from"one-shotters"to"repeated players", in order to compensate for the inequality of resources.
