摘要 本文以C公司诉上海市某区人力资源和社会保障局认定工伤决定案为例,对职工醉酒是否即构成认定工伤的法定阻却事由等问题进行了实证分析,对我国现行法律规范涉及的相关内容及适用范围进行了探讨,提出了职工醉酒情形下认定工伤需要解决的问题。 Based on the case of C Company suing the Human Resources and Social Security Bureau of some district in Shanghai for industrial injury decision, the essay makes an empirical analysis on whether drunkenness constitutes the legal hindrance of industrial injury. It also probes into the relevant contents and scope of application of the current legal norms in China, and puts forward the problems needed to be solved for industrial injury identification in the case of drunkenness.
