摘要
突发公共卫生事件下电影作品首映转网等争议案例的出现,反映出特殊时期版权产品在权利人与社会公众之间的供需失衡,以及版权保护与知识传播之间的利益失衡。究其原因,可以概括为三点,即收益格局的固化导致版权扩张,限制制度的瑕疵导致公众接触机会减少,许可机制的梗塞导致传播效率不高。基于此,在理念层面抓住媒体融合机遇营造共赢版权传播生态,在制度层面完善法定许可制度并尝试引入默示许可制度,在机制层面优化著作权集体管理模式并适当借鉴公益放映经验,是实现突发公共卫生事件下版权利益再平衡的解决之道。
The emergence of controversial cases,such as premiere transferring to the net of film works in public health emergency,have reflected that the contradictions which have emerged in the special time between the supply and demand of copyright products,between the rights holders and the public as well as the partial imbalance between copyright protection and knowledge dissemination.T h e reasons can be summarized in three points:the rigidity of the revenue structure leads to the expansion of copyrights,the flaws in restriction system lead to reduced opportunities for public-contacting,and the obstruction of the licensing mechanism leads to inefficient communication.Based on these,the solutions to rebalance the copyright interests in public health emergency lie in the following steps:seizing the opportunity of media convergence to create a win-win copyright dissemination ecology at the conceptual level,improving the statutory licensing system and trying to introduce an implied licensing system at the institutional level,and optimizing the copyright collective management model and appropriately borrowing from public-welfare-project at the institutional level.
