摘要
医疗场所是工作场所中暴力事件发生最为严重的地方。当前国内暴力伤医总量虽有所下降,但暴力伤医的恶劣性质和严重程度依然严峻,有调查显示医生群体认为职业环境并没有任何改善。暴力伤医事件已经上升为阻碍中国社会发展的一个毒瘤,严重影响了健康中国战略的实施和法治中国建设的进程。暴力伤医何以频发?学术界对暴力伤医的研究很多,但是依然没有揭示出暴力伤医主要的和最为深层的原因——医患双方法治信仰的缺失。从培育患方、医方个体法治信仰的源头出发,结合国家制度完善层面、司法机关司法效率层面,找到新时代抑制暴力伤医频发的法治路径。
The medical place is the most serious place of violence in the workplace.At present,although the total number of violent injured doctors in China has decreased,the bad nature and severity of violent injury doctors are still severe.According to a survey,the doctor group did not think that the occupational environment had improved in any way.Violent medical injuries have become a cancer hindering China’s social development,which has seriously affected the implementation of the strategy of Healthy China and the process of building Legal China.Why do violent injuries happen frequently?There are a lot of researches on violence wounded doctors in academic circles,but the main and the most profound cause still hasn’t been revealed,that is the lack of legal belief between doctors and patients.This paper started from the source of cultivating patients’and doctors’individual belief in the rule of law,combining with the level of national system improvement and judicial efficiency of judicial organs,to find the legal path to curb the frequent occurrence of violent injuries in the New Era.
