摘要
为建立并不断完善公众参与黄河流域生态环境保护的法律制度,提升公众参与黄河流域生态环境保护的意愿和能力,分析了目前黄河流域生态环境保护制度中公众参与层面存在的法律渠道不顺畅、组织建设不完备、公众参与的法律反馈机制欠缺、激励机制缺失、生态环境保护问责机制乏力等问题。提出需要加快创新黄河流域生态环境保护治理举措,搭建公众参与流域生态环境保护的法律平台、增加流域生态环境保护参与主体的数量、细化流域生态环境保护奖励机制,以参与式治理的观点来提升和释放社会组织与公众参与的活力,并通过信息公开、建立信任关系等,最终实现让公众有序、有效参与黄河流域生态环境治理。
In order to establish and constantly improve the legal system of public participation in the Yellow River Basin ecological environment protection and enhance the willingness and ability of the public in the basin ecological environment protection,this paper analyzed the issues of the public participation in the Yellow River Basin ecological environment protection system,such as the legal channel was not smooth,incomplete organization construction,lack of legal feedback mechanism of public participation,lack of incentive mechanism and weak accountability mechanism for ecological environment protection.It was necessary to accelerate innovations in the Yellow River Basin ecological and environmental protection governance measures,build a legal platform for public participation in the ecological environmental protection of the basin,increase the number of participants in the ecological environmental protection of the river basin,refine the ecological environmental protection reward mechanism of the river basin,and adopt a participatory governance perspective to enhance and release the vitality of social organizations and public participation,and through information disclosure,establish a trust relationship and finally realize the orderly and effective participation of the public in the ecological environment management of the Yellow River Basin.
