摘要
版权贸易是共建"一带一路"的重要推动力量。国内版权贸易法律制度的系统性和逻辑性缺失、沿线国家间版权贸易法律制度的地域性差异以及与版权贸易有关的国际法律制度间的冲突,是"一带一路"倡议下中国发展版权贸易所面临的主要法律制度困境。应对困境,首先,中国应积极完善国内法律制度,理顺法律制度间的逻辑关系,在《著作权法》中增加关于著作权对外许可和对外转让的规定。其次,应对法律制度的地域性差异,中国可以"一带一路"倡议为契机,推动知识产权区域制度的一体化。最后,在尊重文化多样性的基础上,中国应考虑充分利用既有的国际贸易法律制度以推动版权贸易的可持续发展。
Copyright trade is a significant driving force for building the"Belt and Road".In this process,there are three main legal system dilemmas which China will be confronted with in the development of copyright trade,including the lack of systematicness and logicality in the legal system of domestic copyright trade,the regional differences in the legal systems of copyright trade among countries along the"Belt and Road"and the clash between international legal systems related to copyright trade.Responding to the dilemmas,firstly,it is necessary for China to perfect the domestic legal system of copyright trade,to settle the logical relationship between legal systems and to enact regulations on the external licensing and external transfer of copyright in the Copyright Law.Secondly,for the regional differences in the legal systems,China could take the"Belt and Road"Initiative as an opportunity to promote the integration of the intellectual property regional system.Thirdly,on the basis of respecting the cultural diversity,China could also make the best of the existing international trade legal systems to achieve the sustainable development of copyright trade.
