摘要
人大主导立法是我国立法制度所确立的一个极为重要的原则,2015年新《立法法》颁布实施以后,地方立法权扩容,地方人大在行使立法权的时候,仍然要坚持人大主导立法这一基本原则;贯彻落实这一原则,是对立法制度以及立法工作本位性的回归与坚持,地方立法权的完善,是实现基层社会治理能力和治理体系现代化的重要一环。鉴于地方立法的实际情况,要坚持地方人大主导立法原则,首先是坚持党领导立法的原则,其次是地方人大立法能力建设,最后是完善公众参与地方立法的相关机制。
The legislation of the National People’s Congress is a very important principle established by our legislative system.After the promulgation and implementation of the new Legislative Law in 2015,the local legislative power was expanded,and the local people’s Congress should still adhere to the basic principle of the people’s Congress leading legislation when exercising its legislative power.Carrying out this principle is the return and adherence to the legislative system and the standard of leg⁃islative work,and the perfection of local legislative power is an important link to realize the moderniza⁃tion of grass-roots social governance ability and governance system.In view of the actual situation of lo⁃cal legislation,it is necessary to adhere to the principle of leading legislation by local people’s con⁃gresses,first of all,to adhere to the principle of party leadership legislation,secondly to build the legis⁃lative capacity of local people’s congresses,and finally to improve the relevant mechanisms for public participation in local legislation.
