摘要
宅基地使用权入市困局,源于社会保障与住房财产权间的内生性矛盾。宅基地的社会保障属性乃农村住房保障供给不足的补充手段,与由国家为给付主体的住房保障相比有所不同。集体经济组织无偿分配宅基地使用权的本质,在于集体经济组织向其成员提供生产生活资料以行使所有权。作为集体经济组织成员之固有权利的收益权的回复,不会导向集体土地的私有化。将宅基地使用权直接转化为集体经营性建设用地使用权或建设用地使用权的方式,在逻辑上都或多或少存在难以自洽之处。关于宅基地制度的改革路径,可以利用集体经营性建设用地自由买卖的规定,通过农民所有的宅基地使用权入市后由集体经济组织取得所有权,集体经济组织向买受人分配相应集体经营性建设用地使用权份额的方式,实现集体经济组织、农民及买受人三方间的“土地置换”,并利用“回购”制度保障农民资格权的充分行使。
The dilemma of the right to use homestead in the market stems from the endogenous contradiction between social security and housing property rights.The property of social security of homestead is a supplement to the insufficient supply of rural housing security,which is different from the housing security which is paid by the state.The essence of collective economic organizations’free distribution of the right to use the homestead is that collective economic organizations provide their members with means of production and living to exercise ownership.The restoration of the right to earnings as the inherent right of the members of collective economic organizations will not lead to the privatization of collective land.Logically,it is more or less difficult to convert the right to use the homestead into the right to use the collective commercial construction land or the right to use the construction land.Land system reform path,can use collective free trade rules of construction land for commercial purposes by farmers in the market all of the right to use house sites after the ownership by the collective economic organizations,collective economic organization distribution corresponding to the buyer the collective business share the way of the right to use construction land,to realize the collective economic organizations,farmers and the buyer“land”between the three parties,and make use of“repo”system fully exercise the right to safeguard farmers’qualifications.
