摘要
乡村企业法律风险评价的科学和合理与否直接关系企业法律风险防控能力。针对乡村企业法律风险的特点,从主体法律风险、知识产权法律风险、财务税收法律风险、合同法律风险、投资融资法律风险、人力资源管理法律风险、保密风险、外部风险8个方面构建乡村企业法律风险指标体系,基于IGWO-ELM的乡村企业法律风险评价模型研究表明,管理队伍建设风险(X_(15))、知识产权权属认定风险(X_(21))、劳动合同履行与变更法律风险(X_(62))、技术保障风险(X_(74))、政策变动风险(X_(83))和新冠疫情与经济危机影响风险(X_(81))6个指标的原因度>0,正向影响乡村企业法律风险;领导干预风险(X_(11))、相关制度的执行与完善风险(X_(13))、知识产权侵权风险(X_(22))、合同履行法律风险(X_(42))、银行贷款融资风险(X_(53))、人员保密管理风险(X71)和核心数据管控风险(X_(73))7个指标的原因度<0,负向影响乡村企业法律风险。提出防范乡村企业法律风险的对策建议,以期为乡村企业法律风险评价、预警及管理提供决策借鉴。
The scientific and reasonable legal risk assessment of rural enterprises is directly related to the legal risk prevention and control ability of enterprises.According to the characteristics of the legal risk of rural en-terprises,the legal risk index system of rural enterprises is constructed from eight aspects:main legal risk,intellectual property legal risk,financial tax legal risk,contract legal risk,investment and financing legal risk,human resource management legal risk,confidentiality risk and external risk.The study on the legal risk evaluation model of rural enterprises based on IGWO-ELM shows that the cause degree of management team construction risk(X15),intellectual property right identification risk(X_(21)),labor contract performace and legal change risk(X_(62)),technical security risk(X_(74)),policy change risk(X_(83))and COVID-19 and economic crisis risk(X_(81))was greater than 0,which have positive impact on the legal risk of rural enterprises.The reason degree of leadership intervention risk(X11),implementation and improvement risk of relevant systems(X13),intellectual property infringement risk(X_(22)),contract performance legal risk(X_(42)),bank loan financing risk(X_(53)),personnel confidentiality management risk(X_(71))and core data control risk(X_(73))is less than 0,which have negative impact on the legal risk of rural enterprises.This paper puts forward the countermeasures and suggestions to prevent the legal risks of rural enterprises,in order to provide decis ion-making reference for the evaluation,and early warning and manageme nt of the legal risks of rural enterprises.
