摘要
推进全民阅读工作法治化建设,是国家在《关于促进全民阅读工作的意见》中提出的一项新命题。作为一项新命题,全民阅读工作法治化建设的有效开展离不开对其价值意蕴和应遵循的基本原则的释明。全民阅读工作法治化建设的价值意蕴,具体体现在公民阅读权利的强化保障、公民文化权利的积极保护、公民阅读义务的合理配置以及国家文化权力的有效运行等四个方面。而全民阅读工作法治化建设的基本原则体系则包括多规范类型协同原则、法律实施优位原则、以政府责任为核心的责任构建原则以及国家统一要求和地方特色兼容原则等。
Promoting the legal construction for nationwide reading is a new proposition put forward by the state in the"Opinions on Promoting Nationwide Reading."As a new proposition,the effective development of the legal constriction of nationwide reading work is inseparable from the interpretation of its value and the basic principles to be followed.The value implication of the legal construction of nationwide reading work is embodied in four aspects:strengthening protection of citizens’reading rights,active protection of citizens’cultural rights,reasonable allocation of citizens’reading obligations,and effective operation of national cultural power.The basic principle system for the legal construction of nationwide reading work includes the principle of coordination of multiple types of norms and types,the principle of superiority in law enforcement,the principle of responsibility construction with government responsibility as the core,and the principle of national unified requirements and compatibility of local characteristics.
