摘要
由于我国离岸金融法律制度尚不完善,在海南自由贸易港推动取消利率管制、汇率放松管制、资本项目开放、资本跨境流动等方面建设时面临潜在的金融风险,需要对海南自由贸易港离岸金融市场的建设、监管力度和风险防范三者之间的平衡进行风险分析预警。通过区分离岸金融风险类型,分析产生原因及影响程度,对比和借鉴各国离岸监管措施,结合海南自由贸易港金融市场的实际建设,从对金融机构的风险防范监管的相关措施、强化防范离岸金融市场经营的业务风险以及促进金融监管体制的改革和创新等方面切入研究,以发挥离岸金融在海南自由贸易港建设中的应有作用。
Due to the imperfection of China’s offshore financial legal system,Hainan Free Trade Port faces the potential financial risks in promoting the interest rate deregulation,exchange rate deregulation,capital account opening and cross-border capital flow.Therefore,it is necessary to carry out the risk analysis and early warning in the construction,supervision,and risk prevention of offshore financial market in Hainan Free Trade Port.While distinguishing the types of offshore financial risks,analyzing the causes and the impact,as well as comparing and learning from the offshore regulatory measures of various countries,this paper holds that the construction of financial market in Hainan Free Trade Port calls for the further research into the relevant measures for preventing and supervising the risks of financial institutions,the enhancement of preventing business risks of offshore financial market operations,and the promotion of the reform and innovation of financial regulatory system.Thus,offshore finance can play its due role in the construction of Hainan Free Trade Port.
