大数据市场竞争属性较为特殊,本质上是一种非价格竞争,质量竞争是其主要手段,且竞争损害带有较强的隐蔽性。对大数据经营者滥用市场支配地位的认定,市场支配地位的市场份额推定标准具有一定的适用性,但需要综合考量大数据的特性、经营者对数据的控制力、大数据市场竞争属性及数据在关联市场的影响力;在滥用市场支配地位认定时,需要细分排他性滥用和剥削性滥用的各个类型;在损害后果认定时,除需要考虑消费者福利及社会公共利益之外,还应该考虑隐私保护、消费者使用成本上升等动态问题;在抗辩事由判断上需要综合考虑效率原则、公平原则和经营必要性原则。基于这些认定标准及因素,在规制过程中需要回应市场主体的正当需求,综合考量大数据在提升经营者市场势力中的作用,健全以成本、质量为核心的分析范式,进一步完善大数据市场反垄断规则及实施细则。
The competitive nature of the big data market is relatively special. It is essentially a non-price competition.Quality competition is the main means,and the damage of competition is highly concealed. For the identification of big data operators’ abuse of market dominance,the market share presumption standard for market dominance has certain applicability,but it is necessary to comprehensively consider the characteristics of big data,the operator’s control over data,the attributes of big data market competition and the data influence in the related market. In determining the abuse of market dominance,it is necessary to subdivide the various types of exclusive abuse and exploitative abuse;in determining the consequences of damage,it is necessary to consider not only consumer welfare and social public interest,but also privacy protection,and dynamic issues such as rising consumer usage costs;and the efficiency principle,fairness principle and the principle of business necessity need to be comprehensively considered in the judgment of the defenses. Based on these identification standards and factors,it is necessary to respond to the legitimate needs of market entities in the regulatory process,comprehensively consider the role of big data in enhancing the market power of operators,improve the analysis paradigm centered on cost and quality,and further improve the antitrust rules and its implementation details of the big data market.
