摘要
西南交通大学开创的职务科技成果混合所有制在实践中面临着职务科技成果权属受法律限制的问题,造成这一问题的原因是2015年修订的《促进科技成果转化法》第19条对职务科技成果权属变更的限制与2008年修订的《专利法》第6条没有明确规定执行单位的任务完成的职务发明创造是否可以通过合同约定其专利权利的归属。2020年,由中共中央、国务院政策所推动的职务科技成果所有权改革试点与全国人大常委会对《专利法》第6条第1款规定的修订,是当前解决职务科技成果权属限制问题的政策与法律路径。基于对问题的成因与当前解决路径进行规范性分析,进一步解决职务科技成果权属限制问题的合理思路应是修订《促进科技成果转化法》第19条,在职务科技成果所有权改革试点中细化权属保留制度与工作协调机制。
The South West Jiaotong University’s Practice of mixed-ownersh ip of technology achievements is at risk to against either the ownership restrictive regulation on the Job-related scientific and technological achievements’ownership by Law on Promoting the Transformation of Scientifi c and Technological Achievements(also known as Technology Transfer Law)or the Patent Law’s ambiguous regulation toward the validity on the contract made for ownership of Service invention-creation.In 2020,the policy and legal resolution of problem are the Ref orm of Pilot Program on ownership of Job-related scientific and technological achievements implanted by the CPC Central Committee and the State Council,and the Patent Law’s amendment legislated by Standing Committee of the National People's Congress.Based on the normative analysis of regulation and policy,the further resolution to the problem shall be the Technology Transfer Law’s amendment of article 19 and the detailed regulation of ownership restraint policy and negotiation working mechanism in reform pilot program.
