摘要
同案同判在司法裁判过程中究竟扮演什么样的角色?司法裁判具有依法裁判和个案正义的二元性质,它们都是司法活动不可放弃的构成性义务,也都是法官的道德义务。同案同判属于依法裁判的衍生性义务,其含义本身就蕴含于依法裁判之中。这种义务虽然是司法裁判的一般性要求,但只具有初始性,始终存在着被其他更重要的理由所凌驾的可能。但是,同案同判具有"溢出"依法裁判之外的表征性价值,也即形式正义的可视化和可预期性的显现化。它并非实操的方法论原则,而是司法裁判之社会效果或者说司法公正的一种价值符号。
What role does the "like cases be treated alike" play in the judicial adjudication? Judicial adjudication has the dual nature of "judgment according to the law" and "justice in individual cases". They are both constitutive duties that cannot be waived in judicial activities and are also moral obligations of judges. "Like cases be treated alike" is a derivative duty of the judgment according to the law, and its meaning is inherent in the latter. Although this kind of duty is a general requirement of judicial adjudication, it only has a prima facie character, and there is always the possibility of being overridden by other more important reasons. However, "like cases be treated alike" has the symbolic value "overflowing" beyond judgment according to the law, that is, the visualization of formal justice and the appearance of predictability. It is not a methodological principle in practice, but a value symbol of the social effect of judicial judgment or of judicial justice.
