摘要
智能传播时代,社会发展更加数字化、信息化,大数据和人工智能技术在便民的同时,不可避免地会引发一系列的隐私安全问题。传统的“隐私”随着互联网的发展逐步向“网络信息隐私”倾斜,“隐私权”的边界也在逐渐模糊化,隐私侵权认定难,公民的隐私权无法得到合理的保护。在智能传播时代引入“合理隐私期待”有其必要性和合理性,既可以灵活界定隐私边界,又可以平衡公民权利与社会公共利益的需要。
In the era of intelligent communication,social development is more digital and information-based.Big data and artificial intelligence technology will inevitably lead to a series of privacy and security issues while facilitating people.With the development of the internet,the traditional“privacy”gradually inclines to“network information privacy”,and the boundary of“privacy right”is also gradually blurred.It is difficult to identify privacy infringement,and citizens'right of privacy cannot be reasonably protected.It is necessary and reasonable to introduce“reasonable expectation of privacy”in the era of intelligent communication.It can not only define the boundary of privacy flexibly,but also balance the needs of civil rights and social public interests.
