摘要
相较于传统电商,社交电商的商事信用保障机制呈现出明显的异化现象,由此导致社交电商的营商环境也面临紧迫的失信危机。社交电商活动中的交易主体、交易合同、交易渠道和交易信息都呈现出其独有特征,这使得传统电商所依附的合同内部预防、平台共享评价和法律外在保障等信用保障机制出现失灵。为此,社交平台应当在身份认证、信用公示、标准化备选合同等方面,从企业社会责任角度出发,借助软法治理手段积极完善社交电商信用保障机制;在国家层面,立法机关应积极推进平台对商个人准登记的相关立法,执法机关应当加大对社交电商违法活动的打击力度,司法机关应当在社交电商纠纷案件中对举证责任进行适度倾斜。
Compared with traditional e-commerce,the commercial credit guarantee mechanism of social e-commerce shows obvious alienation characteristics.The business environment in this era is also facing an urgent crisis of dishonesty.The transaction subject,transaction contract,transaction channel and transaction information in social e-commerce activities all have their own unique characteristics,which makes the credit guarantee mechanism such as contract internal prevention,platform sharing evaluation and legal external protection attached by traditional e-commerce All fail,and the problem of dishonesty has become a key obstacle to optimizing the business environment in the era of social e-commerce.To this end,the social platform should actively improve the social e-commerce credit guarantee mechanism from the perspective of corporate social responsibility in terms of identity authentication,credit disclosure,standardized alternative contracts,etc.At the national level,the legislature should actively promote The relevant legislation on the platform for the registration of individual business,law enforcement agencies should increase the crackdown on social e-commerce illegal activities,the judicial organs should be appropriate in the social e-commerce dispute cases to the burden of proof.
