电子商务平台虚假宣传的法律规制研究

摘要 现如今电子商务平台已经成为人们购物的重要方式,然而,电子商务平台所带来的不仅有巨大的利益和便利,还带来了一些挑战,其中商品的虚假宣传就是一个大问题。违法的商家主要从事虚假宣传手段有三种:商品描述造假、虚假交易和掩盖商品缺陷。针对互联网购物领域虚假宣传行为的规制困境,提出完善相关法律法规、健全第三方交易平台信用评价体系、完善对电子商务平台的监管,以达到有效规范违法主体行为,促进竞争者公平、正当竞争,切实维护消费者及其他诚实经营者合法利益的目的。 Nowadays,e-commerce platforms have become an important way for people to shop.However,e-commerce platforms not only bring huge benefits and convenience,but also bring some challenges,and among them,false publicity of goods is a big problem.The false propaganda methods that illegal businesses mainly engage in have the three basic problems:falsified product descriptions,false transactions and concealment of product defects.In response to the regulatory dilemma of false propaganda in the field of online shopping,it is proposed to improve relevant laws and regulations,perfect the credit evaluation system of third-party trading platforms,and enhance the supervision of e-commerce platforms to achieve effective rules for the behaviors of illegal entities,boost fair and legitimate competition among competitors,and earnestly safeguard the legitimate interests of consumers and other honest operators.
