摘要 随着跨境商业的发展,商标权属地主义逐渐被打破,美国等国司法实践已经基于效果标准将商标权的效力扩张至域外。中国立法对商标权的地域性问题未作规定,司法实践中在商标授权确权案件以及涉外定牌加工案中,一般采用严格的地域性观点,但这并不符合国际贸易全球化的现实需求,应在坚持商标权地域性原则的基础上,以“对相关公众认知的影响”为中心建立商标权域外效力的适用标准。 With the development of cross-border commerce,trademark territorialism has gradually been broken down,and the judicial practice of the United States and other countries has expanded the validity of trademark rights beyond the border based on the effect criterion.China's legislation does not provide for the territorial issues of trademark rights.In judicial practice,strict territorial views are generally adopted in cases of trademark authorization and confirmation and foreign-related original equipment manufacturers,but this does not meet the actual needs of the globalization of international trade.On the basis of adhering to the principle of territoriality,China should establish applicable standards for the extraterritorial validity of trademark rights with the focus on the“impact on the perception of relevant public”.
