摘要
目前,竞业限制在实践中对劳动者泛化适用的问题愈发显著,许多本不必要承担竞业义务的劳动者不得不受到竞业协议的限制。欲对该现象进行规制,应当明确竞业限制的义务主体为知悉商业秘密的劳动者,并将竞业限制的保护客体限定在可能对用人单位造成重大损害的商业秘密范围内。还应当明确对于劳动者是竞业协议适格义务主体的举证责任由用人单位一方承担,同时将利益平衡原则作为个案裁判中的指导原则。
At present,the problem of the application of non-competition to workers is becoming more and more obvious in practice.Many workers who do not need to undertake the obligation of competition have to be restricted by the agreement of competition.In order to regulate this phenomenon,it should be clear that the subject of the obligation of non-competition is the laborer who knows the trade secret,and the protection object of non-competition should be limited to the trade secret which may cause great damage to the employer.It is clear that the burden of proof is borne by the employer that the laborer is the subject of the eligible obligation of the competition agreement,and the principle of balance of interests is taken as the guiding principle in case judgment.
