摘要
在制定数字贸易规则的博弈中,美国、欧盟等数字经济比较发达的国家已经走在前列。与美国主张跨境数据自由流动和欧盟注重隐私保护前提下的自由流动方案相比,中国更加重视数字贸易的监管主权,对市场进入壁垒与源代码相关知识产权议题还没有提出明确方案,在全球数字贸易规则博弈中比较弱势甚至面临被边缘化的风险,而且跨境数据流动领域的严格监管可能引发中国规则与全球规则的脱节。应采取加强数字贸易发展规划顶层设计,提高监管有效性精准性、促进跨境数据自由流动,积极参与全球数字贸易规则制定,加快发展数字经济和数字贸易、增强规则制定博弈底气等措施,提高中国在全球数字贸易规则制定中的话语权。
In the game of formulating digital trade rules,countries with more developed digital economy such as the United States and the European Union have been at the forefront.Compared with the free flow of crossborder data that the United States advocates and the free flow approach under the premise that the European Union pays attention to privacy protection,China pays more attention to the regulatory sovereignty of digital trade and has not yet proposed a clear approach for market entry barriers and source code related intellectual property issues.In the global digital trade rules game,it faces the risk of embarrassment and even marginalization,and the strict supervision in the field of cross-border data flow may lead to the disconnection between Chinese rules and global rules.We should take measures to strengthen the top-level design of digital trade development planning,improve the effectiveness and accuracy of supervision,promote the free flow of cross-border data,actively participate in the formulation of global digital trade rules,accelerate the development of digital economy and digital trade,and enhance the confidence of the rule-making game,so as to improve China’s discourse power in the formulation of global digital trade rules.
