摘要
实证调查表明,前科的长期存在严重阻碍犯罪人员与社会正常融合,并且容易牵扯无辜人员加剧社会矛盾,暴露出构建前科消灭制度的现实需求。消灭前科不仅符合人道主义,有利于抑制重新犯罪遏制株连效应,而且符合世界刑事立法的大趋势。需要从宏观层面与微观层面着手,在转变认识、完善法律规定的同时,引入再犯预测评估机制,平衡社会利益与犯罪人利益。
Empirical investigations show that the long-term existence of criminal records severely hinders the normal integration of criminals with society, and it is easy to involve innocent people to aggravate social conflicts, exposing the actual need to build a criminal record elimination system.The elimination of previous convictions is not only in line with humanitarianism, but is also conducive to restraining re-offending and curbing the effect of conviction.It is also in line with the general trend of criminal legislation in the world.To this end, it is not only necessary to change understanding and improve legislative provisions.Starting from the macro level and the micro level, transform our understanding and improve legal regulations, and at the same time introduce a reoffending prediction mechanism to improve people’s sense of security.Balancing the interests of society and the interests of criminals.
