摘要
对国内主流电子商务平台上AR出版物的销售、宣传、评价信息及其引发的法律纠纷案件等的实证调研发现,我国AR出版“热”的背后存在着一系列的法律风险,包括:同质化竞争引发的不正当竞争风险,“噱头营销”导致的侵犯消费者权益风险,品牌打造中的商标淡化风险,以及跨界合作过程中产生的合同违约、大数据归属不明、后期维护责任不清、知识产权侵权风险等。为防范这些法律风险,出版者在前端的策划生产阶段,应当树立创新理念,确保AR出版物质量,并尽量选择优质技术合作伙伴,做好合作合同审查;在后端销售运营阶段,应当注重品牌维护,规避不正当竞争,走可持续发展道路。出版行业应当进一步完善AR出版物质量标准,规范AR出版物市场。
Based on the empirical research on the sales,producer publicity and consumer evaluation of AR publications on the major e-commerce platforms in China and the legal disputes caused by AR publishing,it is found that there are series of legal risks behind the AR publishing rush in China,including unfair competition caused by homogeneous products,consumers rights infringement by gimmick marketing,trademark dilution,as well as contract breach,unclear ownership of big data,unclear responsibility for later maintenance,intellectual property infringement and the like in the process of cross-border cooperation.In order to prevent these legal risks,publishers shall establish innovative ideas,ensure the quality of AR publications,select high-quality technology partners and have strict contract reviews in the planning and production phase;they shall pay attention to brand maintenance,avoid unfair competition and take the orientation of sustainable development in sales operation stage.In addition,the publishing industry shall improve the formulation of quality standards for AR publications and regulate the AR publication market.
