摘要
近年来,暴力伤医事件的频发给医疗卫生系统带来了诸多负面影响,急需加强暴力伤医问题的治理。文章运用质性分析软件Nvivo12.0,对最高人民法院公布的12件涉医犯罪典型案例文本进行分析,提取患者及其家属暴力伤医的原因、目的、手段以及危害等信息,形成暴力伤医的演化路径模型图。发现暴力伤医的原因在一定程度上决定了暴力伤医的目的,其目的又决定了暴力伤医的手段,其手段最终决定了暴力伤医的危害,整个事件是一个动态演进过程。最后,分别从引导患者及其家属正确看待医疗责任的归因、减少患者及其家属对医务人员的不满情绪、化解患者及其家属在索赔过程中可能发生的暴力行为风险、减轻暴力行为可能给医务人员造成伤害四个方面提出暴力伤医问题的治理策略。
Violence against medical personnel is on the rise in China in recent years which has brought about many negative effects to its medical and health system and needs to be addressed urgently.Using the qualitative analytic software,Nvivo12.0,the paper analyzes the texts of 12 typical medicine-related crimi⁃nal cases published by the Supreme People’s Court,and formulates a diagrammatical figure of the evolu⁃tion path of violence against medical personnel by extracting the causes and aims given by the patients and their relatives,as well as the means and harms.The finding is that the whole event is a dynamic evolution⁃ary process:the cause determines,to a certain degree,the aim of the criminal act,which further deter⁃mines the means that finalizes the detriment of the crime.Governance strategies are proposed from the fol⁃lowing four aspects:guide patients and their relatives to treat medical liability attributions properly;re⁃duce patients’and their relatives’dissatisfaction towards medical personnel;resolve the risk of patients’and their relatives’possible violent behavior in the process of claiming compensation;and alleviate the possible harm done to medical personnel.
