摘要
清末民初之际,继承案件审理跟随社会变动表现出了非常明显的现代性特征。江苏因其独特的地理、经济与人文优势,现代性在民初江苏省体现得尤为突出。在江苏省继承案件审理过程中,民众在诉讼过程中的思想进步、个人在案件审理中的地位提升以及基层司法权收归国家等等,都是现代性的体现。这种现代性过程并不是一蹴而就的,而是国家社会缓慢革新的证明。
During the transition between the late Qing dynasty and the early Republic of China,the trial of inheritance cases showed the very obvious characteristics of modernity with the change of society.Because of its unique geographical,economic and humanistic advantages,the modernity in Jiangsu province was particularly prominent in the early republic of China.In the trial process of inheritance cases in Jiangsu province,the progress of people’s thought in the process of litigation,the promotion of individual’s status in the trial of cases and the transfer of basic judicial power to the state were all manifestations of the modernity.This process of modernity was not achieved overnight,but a proof that the national society was slowly innovating.
