摘要
我国学位授权审批本质上属于行政许可,学位授权审批实践中存在政策管控过严、审批工作失范等现象,涉嫌违反行政许可及行政程序相关法律制度原理或规则。大学学位制度转型难以实现及学位授权审批与高校自主办学不断走向平衡的趋势,决定了基于现有国家学位制度的优化是解决当下学位授权审批法律问题的可行性选择。优化学位授权审批制度需在《学位法》中确立逐步扩大高校办学自主权的法律原则,并明确学位授权审批的行政许可属性,进行竞争性"限量许可"模式改造;在学位授权审批工作中确保省级学位委员会决议能够做到"行政与学术相对分离",并明晰高校在学位审批中的权利救济路径。
In essence,the degree authorization review is the administrative license.Within the practice of degree authorization review,there are strict policy regulations and control,malpractice in approving degrees and some behaviors defying relevant principles and rules in the legal system for administrative license.The difficulty of transition from the national degree system to the university degree system,and the balance between the degree authorization review and university autonomy make it a practical choice to improve the national degree system and settle down the current legal issue of degree authorization review.Then,it should establish law principles gradually enlarging the autonomous operation for the university in the Law of Academic Degree and define the administrative license attribute in the authorization and approval for the change of competitive mold restricting the amount of license.In the practical fulfillment of degree authorization review,it should ensure that provincial degree commissions implement the separation between administration and academic,and unravel the right relief route to approval for the university.
