摘要 专利客体审查以专利适格性为准入门槛,以专利实质审查为核心标准,二者在人工智能算法语境下形成扩张与制约的关系。一方面,开放与发展视角下的专利适格性标准应适当淡化对“物理状态”和“利用自然规律”的关注,侧重对“产业利用性”和“可重复使用性”的考量。人工智能算法兼具抽象思维与技术方案的二重属性,其中抽象属性是表征和基础,技术属性是首要和核心,其足以达到专利适格性门槛。另一方面,专利实质性审查应充分考量人工智能算法发明理性、高效的特性,在实用性判断中过滤明显负面的算法发明;在新颖性判断中合理框定现有技术的检索范围,用具象化的要素进行对比;同时确保创造性判断的标准与技术发展同步。 When the patent system originating from the industrial revolution era meets the innovation of artificial intelligence algorithm in the information technology era,it is inevitable that there will be difficulties in protecting the object of patent rights.Patent object examination takes patent suitability as the entry threshold and patent substan⁃tive examination as the core standard,which forms the relationship between expansion and restriction in the context of artificial intelligence algorithm.On the one hand,the patent suitability standard from the perspective of openness and development should appropriately dilute the attention to"physical state"and"use of natural law",focusing on the consideration of"industrial utilization"and"reusability".Artificial intelligence algorithm has the dual attribute of abstract thinking and technology scheme,in which abstract attribute is the characterization and foundation,the technical attribute is the first and core,which is enough to reach the threshold of patent suitability.On the other hand,the substantive examination of patents should take full account of the rational and efficient characteristics of artificial intelligence algorithm inventions,filter out obviously negative algorithm inventions in practical judgment,reasonably frame the scope of search of existing technology in novelty judgment,compare with figurative elements,and ensure that the standard of creative judgment is synchronized with technological development.
