摘要
在《送法下乡:中国基层司法制度研究》这一研究中国基层司法制度的著作中,苏力认为,司法是现实世界同规范世界的中介和桥梁,法治理想只有落实到中国基层具体的制度和技术层面才能得到实现。通过对苏力关注中国基层司法制度的动因、纠纷解决和规则之治何以达致统一、基层法官的司法知识与国家法如何兼容等问题的剖析,可揭示出苏力透视中国基层司法制度的后现代视角以及在这一过程中他对中国法治的现代性诉求。
Sending the Law to the Countryside:a Study of China's Grass-roots Judicial System is a masterpiece of Su Li’s study of China’s grass-roots judicial system.Su Li believes that justice is the intermediary and bridge between the real world and the normative world.The ideal of the rule of law can be realized only when it is implemented at the specific institutional and technical level at the grass-roots level in China.Through the analysis of Su Li’s motivation to pay attention to China’s grass-roots judicial system,the way to achieve the unity of dispute resolution and the rule of law,and the way to make the judicial knowledge of grass-roots judges compatible with national law,this paper reveals Su Li’s postmodern perspective on China’s grass-roots judicial system and his appeal for the Modernity of China’s rule of law in this process.
