摘要
以法治理念和方法调整科技法律关系是科技立法的核心,科技立法内含科技事务发展性特征和法治安定性追求之间的逻辑张力。中国科技立法属于后发集中型立法模式,带有较强的宣誓性、回应性、引导性和底线把控性历史特征。改革开放以来,中国科技立法体系化和法治化成就显著,也存在局部供需失衡和理念单一的问题。“十四五”时期中国科技立法应从体系完善的传统理念转向兼顾体系逻辑和效能提升的综合进路,同时兼顾科技政策开放性和科技立法的科学性与权威性,应以修改《科普法》等科技核心立法为手段,巩固科技法治的正确历史选择、培育科技创新社会意识和科技法治文化基础。
Adjusting the legal relationship of science and technology with the concept and method of the rule-of-law is the core of science and technology legislation.Science and technology legislation contains a logical tension between the developmental characteristics of science-related affairs and the pursuit of legal stability.China's science and technology legislation is a late-developing centralized form with strong historical characteristics of oath,responsiveness,guidance,and bottom-line control.Since China's reform and opening-up,the systemization and legalization of China's scientific and technological legislation have made remarkable achievements,along with the problems of local imbalance between supply and demand and single-mindedness.The science and technology legislation during the 14th Five-Year period should shift from the traditional concept of system perfection to a comprehensive approach that takes into account system logic and legal efficiency by taking into account the openness of policy and the scientific and authoritative nature of the legislation.Revising the Promulgation of Science and Technology Law and other core legislation should be the method to consolidate the existing correct historical choices,and to further cultivate the social awareness of innovation and the cultural foundation of rule-of-law in scientific and technological affairs.
