摘要
当前平台经济构成我国重要的新经济形态,平台用工日益成为重要的新就业形态。应看到,平台经济从业人员普遍工作时间长、工作强度大、社会保障体系发展滞后,平台用工存在对劳动者社会保护不足的问题。平台在劳动关系中处于事实上的绝对优势地位,以及平台用工法治建设的滞后,是平台用工劳动保护不足的两个重要原因。对平台用工应按照顺势而为、促进健康发展的思路,从注重鼓励转向积极规范和引导,实现经济效益和社会效益的最大化。当务之急是加强适应数字时代劳动关系发展需要的法治建设,建立行业劳动基准协商机制,规范平台权力,促进平台与从业人员之间健康和谐劳动关系的构建。同时,要适应数字化转型趋势尽快构建新型职业伤害保障制度,保障平台用工尤其是平台灵活就业人员的正当权益。
At present,the platform economy constitutes an important new economic form in China,and the platform employment correspondingly becomes an important new employment form.At the same time,it should be noted that the workers of typical platform economy industry work long hours and have high intensity,the development of social security for platform flexible employment personnel lags behind,and the current platform employment has the problem of insufficient social protection for workers.The absolute advantage of platform in labor relations and the lag of legal construction of platform employment are two major reasons for the lack of labor protection of platform employment.In order to maximize the economic and social benefits,we should follow the trend and promote the healthy development of platform employment.The urgent task is to improve the legal construction to meet the needs of the development of labor relations in the digital era,establish the industry labor benchmark negotiation mechanism,constrain the power of the platform,and build a healthy and harmonious labor relationship between the platform and workers.At the same time,we should actively build a new occupational injury protection system to meet the needs of the digital era,so as to ensure the rights and interests of the employees/workers especially the flexible workers of the platform.
