摘要
森林的生态价值、经济价值与文化价值形成了森林价值的统一体系,各价值之间是一种辩证统一的关系,更是一种互促共进的关系。森林文化是人类认识和使用森林资源过程中形成的全部精神活动及其产物。生态文明入宪背景下,森林文化价值的法制表达直接关系人民身心健康、生活质量及幸福指数。在梳理森林文化价值法制表达的历史脉络及时代需求的基础上,探究其演进规律与内在逻辑,指出森林法则的人本气息应进一步加强、森林法制理论价值体系需进一步拓展、森林价值体系在《森林法》中应进一步统合,最后提出“总则明确规定+分则相对细化”的技术路径以充分实现《森林法》的文化担当。
Forest culture is the entire spiritual activity and its products formed in human understanding and use of forest resources.In the context of the constitution of ecological civilization,the legal expression of forest culture value is directly related to people’s physical and mental health,quality of life,and happiness index.The ecological,economic,and cultural values of forests form a unified system of forest values.Each value is a dialectical and unified relationship,moreover,a relationship of mutual promotion and progress.Based on sorting out the historical lineage of the legal expression of forest cultural values and the needs of the times,exploring its evolution law and internal logic,pointing out that the humanistic atmosphere of forest law should be further strengthened,the value system of forest law theory needs to be further expanded,and the forest value system should be further unified in the Forest Law.Finally,we propose the technical path of“Clear General Provisions+Detailed Specific Provisions”to fully realize the cultural responsibility of the Forest Law.
