浅析相同反应位点的现有技术对合成方法专利创造性评判的影响

A brief analysis on the influence of the prior art with the same reaction site on the inventiveness assessment of synthetic method invention

摘要 "三步法"是合成方法专利创造性判断的最基本方法。本文结合4件专利的审查实践案例,从创造性成立的正反两方面进行了分析讨论,指出要特别注意通过技术效果的客观比较以确定发明实际解决的技术问题,才能对申请人在申请日时已经完成并且如实公开的技术贡献进行客观评价。 The three-step method still can be followed as a most basic approach to assess whether an invention of synthetic method poses inventiveness.The article analyzed and discussed the finding of inventiveness from both positive and negative aspects combined with four practical cases of patent review,and pointed out that it is necessary to objectively compare the technical effects to determine the technical problem actually solved by the invention,so as to make an objective evaluation of technical contribution that has been completed and truthfully disclosed before the filing date.
