摘要
限制被调查人人身自由的留置措施本质上属于保障调查程序顺利进行的审前羁押措施,性质上属于准刑事强制措施。留置措施必要性审查的理论依据在于比例原则、羁押例外原则及令状主义。考虑到顺畅衔接刑事逮捕、保障刑罚实效等方面的现实动因,留置措施应当被限定为在动用其他监察措施难以保障调查程序顺利进行的情况下具有最后手段性的监察措施。享有留置决定权的监察机关在事前及事后均须对留置必要性进行审慎评价,以防范留置措施适用的恣意扩张。只有吻合留置措施必要性全部指标的被调查人,才能肯定留置措施必要性。为确保留置措施在法治框架内稳健运行,还应完善留置措施的替代措施、变更制度以及监督机制等配套措施。
The monitoring detention which restricts the freedom of the person who is under investigation is essentially a measure of pretrial detention that guarantees the smooth progress of the investigation procedure.The theoretical basis of the review of the necessity of lien measures lies in the principle of proportionality,the principle of exception to detention and the doctrine of warrant.For the realistic need for connecting with arrest smoothly and ensuring the effective punishment of real motivation,monitoring detention shall be define as the ultima ratio of supervisory measure,which apply to the situation that other measures prove to be ineffective.In order to prevent the arbitrary expansion of the application of monitoring detentions,the supervisory authorities should carefully evaluate the necessity of monitoring detention before and after the decision.Only those investigated who are consistent with all the indicators of the necessity of monitoring detention can confirm the necessity of monitoring detention.In addition,it is necessary to construct the alternative measures,change the system and supervision mechanism of the monitoring detention.Therefore,a system centered on necessity review is formed to ensure the stable operation of monitoring detention within the framework of rule of law.
