摘要
作为基础教育的补充,被称为“影子教育”的校外培训行业近年来蓬勃发展,各类培训机构呈爆发性增长。但与此同时,教育机构管理面临市场失灵和监管失灵的双重困境。传统的主张政府作为唯一监管主体的监管一元论难以有效应对当下的复杂环境,因而需要通过政府、非政府及各类社会主体共享监管权、协同监管来实现校外培训机构的法治化监管。一方面,政府作为管理的主体,应完善政策法律的内容与程序规定,对校外培训机构治理进行系统规划,提高教育机构准入的门槛和加强法律的执行力度;另一方面,社会组织、高校、市场和消费者共同参与监管,实现以人为本、鼓励创新和包容审慎的协同监管范式。因此,将“治理型监管”的理论融入我国校外培训机构的监管法治化机制建设,有助于提出建立以政府为主导,行业协会、市场主体等多方协同的监管机制,加强过程监管,弥补事后监管的空缺,同时也是对“治理型监管”本土适用性以及话语体系构建的加强。
As a supplement to basic education,the off-campus training industry known as“shadow education”has developed vigorously in recent years,and all kinds of training institutions have increased explosively,a contrast with the failure both in market and regulation,a dilemma in the management.The traditional monism of supervision that advocates the government as the sole supervision subject cannot well address current complex situation.Therefore,a sharing of supervision power and a collaboration with non-governmental organizations and various social subjects are necessary to ensure a law-based supervision.On the one hand,the government,as the main body of management,should improve the contents and procedures of policies and laws,systematically plan the governance,improve the threshold of access of educational institutions and strengthen the implementation of laws;on the other hand,social organizations,colleges and universities,the market and consumers should participate together in supervision to realize the collaborative supervision paradigm that puts people first,encourages innovation,and bears inclusiveness and prudence.Therefore,an integration of“governance-oriented supervision”into the construction of the supervision legalization mechanism of China’s off-campus training institutions will help to put forward the establishment of a supervision mechanism led by the government and coordinated by industry associations and market subjects,strengthen in-process supervision and make up for the vacancy of after-event supervision.At the same time,it further stretches to the local applicability of“governance-oriented supervision”and the construction of discourse system.
