摘要
监察职务违法调查权承继于原行政监察权,监察机关在职务违法案件中适用留置应有别于职务犯罪案件。职务违法留置的适用可建构信息来源的线索评估机制,并确立书面的审查程序。从审批层面,职务违法留置的适用应恪守比例原则,明确基于职务违法调查留置"手段"与"目的"之间的程序相称性要求。监察机关应对职务违法留置的决策裁量借鉴行政裁量基准理论,引入规范主义导向下的控权模式、功能主义导向下的建构模式以及信息公开和参与的协商规制模式,确立职务违法"严重性"的具体限度,重构职务违法留置的合理期限范围。在职务违法留置的执行层面,立法可考量"相对令状主义"的适用空间,完善留置执行的公法人协助义务,并构建职务违法留置执行场地的特殊羁押监管标准。
The right to investigate the duty violation is inherited from the original administrative supervision right,and the application of lien by supervisory organs in duty violation cases should be different from that of duty crime cases.The application of illegal post retention can construct the clue evaluation mechanism of information sources and establish a written review procedure.From the level of examination and approval,the application of illegal retention of duty should abide by the principle of proportionality,and the requirement of procedural proportionality between "means" and "purpose" of retention based on illegal investigation of duty should be made clear.The supervisory organ should learn from the benchmark theory of administrative discretion in the decision-making of illegal retention of posts,and introduce the power control mode under the guidance of norms,the construction mode under the guidance of functionalism and the negotiation and regulation mode of information disclosure and participation,so as to establish the specific limit of the "severity" of illegal retention of posts and reconstruct the reasonable term range of illegal retention of posts.On the enforcement level of illegal retention of duties,legislation can consider the applicable space of "relative writ doctrine",perfect the obligation of assistance of public legal person in retention enforcement,and construct the special detention supervision standard of the enforcement site of illegal retention of duties.
