摘要
我国校外培训机构监管历经前监管(2014年之前)、弱监管(2014-2018年)及强监管(2018年至今)三个阶段。当前的监管模式在厘清监管思路、建立监管组织、完善监管制度方面取得显著进展,但仍存在准入标准欠妥当、监管职责不明确、监管机制较乏力等局限。为实现校外培训机构的有效监管,应首先以善治理念为指引,完成从政策干预到法律主治、从行政管理到合作治理、从管控为主到堵疏结合、从主体管制到行为规制的理念转型。在此基础上引入清单管理模式,通过加强相关立法、建立“制度清单”,厘清监管权限、明确“权责清单”,降低准入门槛、实行“负面清单”,健全运营要求、完善“底线清单”来完善制度体系,从而实现政府监管与行业发展的平衡,促进培训教育治理现代化。
The regulation of China’s out-of-school training institutions has gone through three stages:pre-regulation(before 2014),weak regulation(2014-2018)and strong regulation(2018-present).The current regulation of out-of-school training institutions has made significant progress in clarifying regulatory thinking,establishing regulatory organizations and improving regulatory systems,but there are still limitations such as inappropriate access standards,unclear regulatory responsibilities and weak regulatory mechanisms.In order to achieve effective regulation of out-of-school training institutions,we should first take good governance as a guide,and complete the conceptual transformation from policy intervention to legal governance,from administrative management to cooperative governance,from control-oriented to combination of blocking and sparing,from subject control to behavior regulation.And on this basis,the list management model should be introduced,and through strengthening relevant legislation and establishing system list,clarifying regulatory authority and specifying power and responsibility list,lowering access standards and implementing negative list,improving operational requirements and improving the bottom line list to optimize the regulatory system,so as to achieve a balance between government regulation and industry development and promote the modernization of training and education governance.
