摘要
消费者个人信息成为助力电商产业发展的重要资源,但近年来电商平台消费者信息泄漏的事件却多有发生。实践中电商平台多通过制定隐私政策来保护消费者个人信息,通过对6类12家电商平台的隐私政策进行分析比较发现,其内容主要包括信息收集和使用,存储与保护,共享、转移和披露,用户权利,未成年人保护,Cookie和同类技术6个方面,其中存在诸如主体间对话困难,信息处理规则模糊,可携带权利落地困难,存储和保护事项告知不明,未成年人信息保护不足、外部监管机构设置不到位等问题,可以通过夯实法律基础、拓宽对话路径、健全审查机制、强化全流程监管、推行公益诉讼等手段,优化和实现对电商消费者个人信息的有效保护。
With the increasing diversification of business transactions,consumers’personal information,as a central issue,has become an important resource that contributes to the development of e-commerce industry.However,recent years have witnessed a large amount of consumer information leakage on e-commerce platforms.In practice,most E-commerce platforms build consumers’personal information protection into its system through formulating privacy policies.By analyzing and comparing the privacy policies provided by 12 e-commerce platforms of 6 categories,it is clear that the contents of these privacy policies mainly cover six aspects:information collection and use,storage and protection,transfer and disclosure,consumers’rights,protection of minors,cookies and similar technologies.Many defects could be seen in the privacy policies of these platforms,such as challenges for communication between subjects,excessive information processing,unclear notification of handled matters,fuzzy rules,and insufficient protection of minors.In order to facilitate the operation of E-commerce industry,this paper proposes some effective protection measures for personal information,such as consolidating the legal foundation,improving the review mechanism,promoting public interest litigation,strengthening the whole process supervision,and broadening the path of dialogue between the E-commerce platforms and the customers.
