摘要
半导体产业是国家经济和国家安全的基础,属于政策密集型产业。为保持政策的稳定性,产业政策的法制化是必要的。美国等发达国家,在半导体产业政策法制化方面积累了一定的经验,有力地支撑起所在国半导体产业的可持续发展。我国半导体产业政策法制化存在法律位阶低,立法技术不够成熟等问题。要解决这些问题,中国半导体产业政策法制化必须提高法律位阶,以增强产业政策的约束力和稳定性;优化立法程序,以增强产业政策立法的科学性;强化试点,以点带面,以增强产业政策立法的可行性。
The semiconductor industry is the foundation of national economy and national security.It is a policy-intensive industry.To maintain policy stability,legalization of industrial policies is necessary.Developed countries,such as the United States,have accumulated considerable experiences in legalization of semiconductor industry policies,which strongly supported the sustainable development of their semiconductor industries.The legalization of our country’s semiconductor industry policies still has some problems,such as low legal hierarchy and immature legislative technologies.To solve these problems,the legalization of China’s semiconductor industry policies must improve the legal hierarchy to enhance the binding force and stability of industrial policies,optimize legislative procedures to enhance the scientificity of industrial policy legislation,push pilot districts to the whole country to ensure the feasibility of industrial policy legislation.
