摘要
刑事合意理念下,“放弃正式审判制度”成为刑事诉讼新潮流,然而作为控辩实质性协商关键的被告人处分权未有明确规定,以散装样态分布于《刑事诉讼法》及其司法解释之中,隐匿于“同意”“无异议”等字眼之下。刑事合意下被告人处分权有其独有的生成逻辑,即以被告人程序主体地位为基础,刑事合意理念为前提,形式真实主义为辅助。有必要基于被告人同意理论,对合意下被告人处分权雏形进行法条的整理、分析。《刑事诉讼法》第十五条“同意”下,被告人处分权囊括认罪处分权、认罚处分权和程序适用处分权。以《刑事诉讼法》及其司法解释中被告人“无异议”为视角,被告人权利处分包含证人出庭处分权和审前争点确认处分权。同时,明确被告人处分权内涵,保障被告人权利处分自愿性,以及确立多元化的证明标准是被告人处分权的基本构建条件。
Under the concept of criminal agreement,“giving up the formal trial system”has become a new trend in criminal procedure.However,as the key of substantive negotiation between prosecution and defense,the defendant’s disposal right has not been clearly stipulated,which is distributed in bulk in the Criminal Procedure Law and hidden in terms such as“consent”and“no objection”.Under criminal agreement,the defendant’s disposal right has its own unique generation logic,which is based on the defendant’s procedural subject status,criminal agreement as the premise and the assistance of formal realism.It is necessary to sort out and analyze the embryonic form of the defendant’s disposal right under the agreement based on the defendant’s consent theory.Under the article 15“consent”of the Criminal Procedure Law,the defendant’s disposal right includes the right to plead guilty,the right to recognize punishment and the right to apply procedure.From the perspective of“no objection”of the defendant in criminal Procedure Law,the defendant’s disposal right includes the right to ask the witness to appear in court and the right to confirm pre-trial contention points.At the same time,the basic construction conditions of the defendant’s disposal right are to clarify the connotation of the defendant’s disposal right,protect the voluntary nature of the defendant’s disposal right,and establish diversified standards of proof.
