摘要
基于制度演化视角,从《教育法修正案第九条》演化进程和不同组织、机构对不同时期大学体育性别平等制度的回应两个维度,探讨了美国大学体育性别平等的政策沿革、制度支持和运行机制。研究发现:美国大学体育性别平等制度历经初创时期、拓展时期和完善时期。在制度支持方面,政府立法为大学体育性别平等提供了法源依据,法院判例促进了大学体育性别平等的规范发展。美国大学体育性别平等发展的运行方式既受制于政府部门行政计划和社会组织指导服务的引导性作用,又受到政府监督协调、组织评价反馈的约束性影响。
From the perspective of the institutional evolution, the paper discusses the policy evolution, institutional support and operating mechanism of gender equality in college sports in the United States from two dimensions: the evolution process of The Ninth Amendment to the Education Act and the responses of different organizations and institutions to the gender equality system in college sports in different periods. It is found that the gender equality system in American university sports has gone through the initial period, the expansion period and the improvement period. In terms of institutional support, the government legislation provides a source of law for gender equality in university sports, and the court cases promote the normative development of gender equality in university sports. The operation mode of the development of gender equity in U.S. college sports is not only restricted by the guiding role of the administrative plan of the government departments and the guidance service of the social organizations, but also restricted by the government supervision, coordination and the evaluation feedback.
