摘要
不动产统一登记以来,出现了一些登记错误引发的行政案件和信访纠纷。2017年,自然资源部办公厅印发《关于加强不动产登记工作人员管理的通知》,要求“有条件的地方,可以探索建立不动产登记责任保险制度,分散登记风险,保障不动产登记工作人员合法权益不受损”。本文结合湖南省实际情况,初步探究建立不动产登记错误赔偿责任保险机制路径,旨在维护不动产权利人的合法权益,分散不动产登记机构赔偿风险,提升不动产登记的公信力,创新完善不动产登记机构日常管理制度规范。
Since the unified registration of real estate,there have been some administrative cases and petition disputes caused by registration errors.In 2017,the General Office of the Ministry of Land and Resources issued the“Notice on Strengthening the Administration of Real Estate Registration Staff,Requirements”.It required that in conditional areas,we can explore to establish a real estate registration liability insurance system to disperse the registration risks and ensure that the legitimate rights and interests of real estate registration staff are not damaged.Based on the actual situation in Hunan Province.The path to establish the mechanism of liability insurance for real estate registration errors was explored initially.It aims to safeguard the legitimate rights and interests of the real estate right holders,disperse the compensation risk of real estate registration agencies,enhance the credibility of real property registration,and innovate and improve the daily management system of registration agencies.
