摘要
互联网技术的发明改变了传统经济发展模式,带给无数人便捷。然而互联网经济的发展也带来了负面问题,大数据“杀熟”就是其中的典型,大数据“杀熟”通过分析消费者的数据信息,实施价格差异的歧视,将消费者置于不公平交易的同时,造成市场恶性竞争,对市场经济的发展也是大为不利的。而这一行为构成条件分析,违反了反垄断法的相关规定,所以反垄断法理应进行规制。因此文章以反垄断法为视角,对大数据“杀熟”这一行为进行分析,并对如何解决这一问题提出相关对策。
The invention of Internet technology has changed the traditional economic development model and brought convenience to countless people.However,the development of the Internet economy also brought negative issues,big data-enabled price discrimination is one of the typical example.By analyzing the data of consumer information,it discriminates against price difference,put consumers at unfair trade at the same time,also caused the market malignant competition,also is greatly detrimental to the development of market economy.And this behavior constitutes the analysis of conditions,in violation of the relevant provisions of the anti-monopoly law,so the anti-monopoly law should be regulated.Therefore,from the perspective of antitrust law,this paper analyzes the behavior of big data-enabled price discrimination and puts forward relevant countermeasures on how to solve this problem.
