摘要
[目的/意义]数字资源引进是公益图书馆在发展过程中无法回避的重要任务。随着数字资源的集中化以及著作权交易模式的复杂化,公益图书馆与商业性学术数据库之间的矛盾愈演愈烈。公益图书馆如何应对数据商的合同压制、技术限制,仍然是一个值得深入研究的现实话题。[方法/过程]从数字资源引进协议中数据商对公益图书馆的具体限制入手,分析现行法律可提供的救济,并对商业性学术数据库优势地位的形成及其原因进行综合分析。[结果/结论]商业性学术数据库优势地位的形成,是技术、政策、经济等多重因素共同作用的结果,法律的调节作用有限。图书馆要化解困境,就应当注重技术、市场等其他因素。其中可倚仗的外力干预包括发展开放获取、调整评价体系、联合学术抵制、引入多元竞争等方式,来弱化商业性学术数据库的市场集中度,倒逼其调整商业模式。公益图书馆自身也可通过发展图书馆联盟、探索新的资源采购模式、优化馆藏资源结构等手段增强自我博弈能力。
[Purpose/significance]The introduction of digital resources is an important task in the development of public libraries.With the centralization of digital resources and the complication of copyright trading mode,the contradiction between public libraries and commercial academic databases becomes more and more intense.How to deal with the contract suppression and technical restrictions of data vendors is still a realistic topic worthy deep study.[Method/process]Starting with the restrictions from data vendors in the digital resource introduction agreement,this paper analyzes that the relief provided by the current law is very limited,and how the dominant position of commercial academic database comes into being.[Result/conclusion]The dominant position of commercial academic database is the result of multiple factors such as technology,policy and economy,and the role of law is limited.Thus public libraries should focus on the other factors.The external interventions that can be relied on includes developing open resources,adjusting academic evaluation system,participating in academic boycott,introducing diversified competition,which can be weaken the market concentration of commercial academic databases,and force commercial academic database to adjust business model.The public libraries themselves can also strengthen their self-game ability by means of developing and expanding library alliance,exploring new resource purchasing mode and optimizing the structure of collection resources.
