摘要
对外关系法是一国调整其对外关系(涉外关系)的所有法律规范的总称。中国特色对外关系法是习近平法治思想和习近平外交思想的共同体现。构建中国特色社会主义对外关系法律体系是打破西方法律霸权主义的需要,是统筹中国国内法治和国际法治建设的需要,是当前国际形势和对外政策的迫切需要,是中国参与全球法律竞争的需要。中国特色对外关系法需要在学科体系、学术体系、话语体系等方面充分体现中国特色、中国风格、中国气派。中国特色对外关系法必须倡导和坚持以习近平新时代中国特色社会主义思想为基础的中国范式。这一新范式首先应当以习近平新时代中国特色社会主义外交思想为具体指导方针,坚持中国共产党的领导,坚持社会主义方向,服务于中国特色大国外交,紧扣依法治国总目标,坚持辩证唯物主义和历史唯物主义研究方法,坚持人类命运共同体理念。
Foreign relations law is the general term for all legal norms for a country to adjust its foreign relations.Foreign relations law with Chinese characteristics is the manifestation of Xi Jinping Thought on Rule of Law and Xi Jinping Thought on Diplomacy.Constructing the legal system of foreign relations under socialism with Chinese characteristics is the need to break the western legal hegemony,to coordinate the construction of domestic and international rule of law,to meet the requirements of the current international situation and foreign policies,and to participate in global legal competition.Foreign relations law with Chinese characteristics needs to fully reflect Chinese paradigm in terms of discipline system,academic system and discourse system.Foreign relations law with Chinese characteristics must advocate and adhere to the Chinese paradigm on Xi Jinping Thought on Socialism with Chinese characteristics for a New Era.This new paradigm should adhere to the leadership of the Communist Party of China,adhere to the socialist approach,adhere to the concept of a Community of Shared Future for Mankind.
