摘要
数字技术介入到行政活动中,引发了行政活动在空间布局与活动场景的变换、活动方式的升级与活动理念的更新。行政活动多方面的变化也带来了行政程序在定位转变、内容调适等方面的连锁反应。对于授益性行政行为而言,数字技术驱动下形塑的“整体政府”理念,要求程序设计应当以用户需求为中心,以提升用户体验作为程序的新定位;调适相应的内、外部程序内容使之与定位契合。对于损益性行政行为而言,数字技术的介入挑战传统正当程序要求,吞噬相对人享有的程序性权利,可通过引入“技”“法”相结合的手段进行补强,更新对正当程序的理解。行政程序法典的立法讨论中,应注意对数字技术介入行政活动的回应,加大对数字化相关程序规范的关注。
The involvement of digital technology in administrative activities has triggered changes in the spatial distribution and activity scenes, upgrade of the form of administrative activity modes, update of the concept of administrative activities.The changes in administrative activities have also brought about a chain reaction of administrative procedures in terms of positioning changes and content adjustments.For beneficiary administrative behaviors, the concept of “holistic government” shaped by digital technology requires that procedure design should be centered on user needs, and user experience should be improved as the new positioning of the procedures;adjust contents of the corresponding internal and external procedures to make it fit the positioning.For profit-and-loss administrative behaviors, digital technology continues to challenge the traditional due process requirements and swallow the procedural rights enjoyed by the counterparty.Through the introduction of combining technology and law, the procedures can be reinforced.We need to update our understanding of due process.In the legislative discussion of the administrative procedure code, attention should be paid to the response to the intervention of digital technology in administrative activities and to the procedural norms related to digitalization.
