摘要
《青藏高原生态保护法》需要国家发挥高地生态宏观调控机制,从全局上对青藏高原生态保护提供战略性、全局性和宏观性的指导和引导,实现青藏高原可持续发展。高地宏观调控机制是《青藏高原生态保护法》立法的必然选择,我国现行《宪法》为其提供了正当性依据。在具体实施路径上,应明确高地生态宏观调控的权力主体、央地事权划分标准,制定由中央发挥高地生态宏观调控机制的事权清单,规范宏观调控工具,并注重差别性和特殊性的制度选择,以实现中央发挥高位统筹协调作用,建立其在青藏高原高地生态环境治理中的宏观调控角色,整合各方资源突破行政区域划分造成的高地生态治理分割化,实现青藏高原可持续发展。
Qinghai-Tibet Plateau Ecological Protection Law needs the state to give full play in the highland ecolog⁃ical macro-regulation mechanism,and provide strategic,overall and macroscopic instruction and guidance for the ecological protection of the Qinghai-Tibet Plateau from the overall point of view,so as to realize the sustain⁃able development of the Qinghai-Tibet Plateau.Highland macro-regulationmechanism is an inevitable choice for the enactment of Qinghai-Tibet Plateau Ecological Protection Law,and the livingconstitution of China pro⁃vides the law justification.In terms of the specific institutional path,it is necessary to clarify the authority sub⁃ject of highland ecological macro-regulation,and make the authorization clarification of the central and local gov⁃ernment,that is to say to clearly define the authorityof the central government in highland ecological macro-con⁃trol mechanism.With the final aim of achieving the sustainable development of the Qinghai-Tibet Plateau,it is also essential to standardize macro-regulation tools,and pay attention to the different and special institutional choices so as to realize the central government to play the role of planning and coordination at a high level,under⁃taking macro-regulationin ecological environmental governance of the Qinghai-Tibet Plateau,and integrating all resources to break through the segmentation of highland ecological governance caused by the division of adminis⁃trative regions.
