摘要
中国早已成为全球专利申请第一大国,但专利的含金量还不能与专利的数量相匹配,创新实力与影响力仍然有待提升。其原因在于,我国专利价值评估体系尚不完善的背景下,“重量轻质”的历史专利政策导向引发了大量低价值、低质量专利的产生,而专利代理行业的不规范行为则在其中起到了推波助澜的作用。促进我国专利从“量变”走向“质变”是建设知识产权强国的必由之路,围绕专利价值提升这一任务开展政策布局势在必行。本文从专利政策导向调整、专利价值评估体系建设和专利代理行业引导三方面分别提出了政策建议。
China has already become the country with the largest number of patent applications in the world,but the value of patents cannot match theirs number,and China’s innovation strength and influence still need to be improved.The reason is that under the background that China’s patent value evaluation system is not yet perfect,the historical patent policy orientation of“emphasizing quantity over quality”has led to the production of a large number of low-value and low-quality patents,and the irregular behavior of the patent agency industry has played an important role in it.Promoting China’s patents from“quantity increase”to“qualitative improvement”is the only way to build a strong intellectual property country,and it is imperative to carry out policy layout around the task of increasing patent value.This paper puts forward policy suggestions from three aspects:the adjustment of patent policy orientation,the construction of patent value evaluation system and the guidance of patent agency industry.
