摘要
法治现代化是当代中国人追求的社会文明进步的重要目标。实现法治现代化需要多种条件,法治能力即是条件之一。法治现代化是与社会变迁过程相适应的法治文明发展进程,法治能力是公权力机关、公职人员和全体国民依法履职、依法办事的素质和能力,法治现代化与公权力机关法治能力存在密切的内在关系。当前公权力机关法治能力存在一些问题和短板,提升公权力机关和公职人员法治能力,要确定工作原则和层级侧重点,并抓好评估、规划、学习与训练三个关键环节。
The modernization of rule of law is an important goal for social progress pursued by the Chinese people.Its realization requires various conditions,one being the capacity for rule of law.The modernization of rule of law is a development process compatible with social changes;the capacity for rule of law shows the competence and capability of public power organs,public officials,and all citizens to perform their duties and act in accordance with the law,so the modernization of rule of law and the capacity for rule of law of public power organs bear a close inherent relationship.At present,however,there are some problems and shortcomings in the capacity for rule of law in public power organs.To improve the capacities of these organs and public officials,it is necessary to determine their working principles and priorities and to grasp the three key links of assessment,planning,and learning and training.
